Purpose
These terms and conditions of sale (“T&Cs”) govern purchases made on the website nevola.ca (the “Site”), operated by Nevola (“we”, “us” or “Nevola”).
Any order placed on the Site implies full and complete acceptance of these T&Cs.
Products
The products offered on the Site are hot/cold anti-migraine caps and related accessories.
We do our best to present the products and their colours as accurately as possible, but slight variations may occur depending on the screen.
Prices
Prices are shown in Canadian dollars (CAD), applicable taxes extra, unless otherwise stated.
We reserve the right to change our prices at any time, but products will be invoiced based on the rate in effect at the time the order is confirmed.
Promotions and discount codes are only valid for the period indicated and cannot be combined, unless otherwise stated.
Orders
To place an order, you must:
add one or more products to your cart
fill in your shipping and billing information
choose a payment method
confirm your order
You will then receive a confirmation email summarizing your order.
We reserve the right to cancel an order in case of payment issue, incomplete information, or suspected fraud.
Payment
Payments are processed via secure payment platforms (e.g. credit card, Apple Pay, Google Pay, Shop Pay, depending on the options available at checkout).
Your payment method is charged at the time the order is confirmed.

Delivery times are provided for information purposes only and may vary depending on the carrier, time of year or circumstances beyond our control.
In the event of a significant delay, we will do our best to assist you with the carrier, without being able to guarantee systematic compensation.
Returns, exchanges and refunds

You generally have 30 days after receiving your order to request a return, provided the product is clean, in good condition and reusable.
Responsibility for return shipping costs depends on the reason (defective product or our error vs. change of mind).
Use of products
Our caps are designed for home use.
Always follow the instructions for use provided in the box (time in the freezer, application duration, safety precautions, etc.).
Nevola is not a substitute for medical advice or treatment. In case of doubt, unusual pain or a particular medical condition, consult a healthcare professional.
Limitation of liability
Nevola cannot be held responsible for:
any damage resulting from misuse of the product or failure to follow the instructions
delays or inability to deliver due to events beyond our control (strikes, bad weather, carrier issues, force majeure, etc.)
indirect damages (loss of income, loss of data, etc.)
Our liability, if incurred, is limited to the amount of the order concerned.
Intellectual property
The content of the Site (texts, images, logos, design, names, etc.) is the property of Nevola and/or its partners.
Any reproduction, distribution or unauthorized use of these elements is prohibited.
Personal data
The information you provide when ordering is used to process and deliver your order, as well as to provide after-sales service.

Governing law and disputes
These T&Cs are governed by the laws in force in the province of Quebec, Canada.
In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the competent courts of Quebec may be seized.
